The regular meeting of the Planning & Zoning Commission of the
City of Stephenville , Texas was called to order by Chairman
Charles Castleberry with the following members Present :
Chairman : Charles Castleberry
Members : Billy Hassler
Nicki Beth Jones
Helen Martin
Jerry Singleton
Barbara Terrell
Bill Trogdon
and with the following members absent : Don Beach, Virginia Dorris
and David Tomlinson.
Others attending were Director of Public Works Danny Johnson,
Building Inspector Steve Brown, Planning & Inspections Coordinator
Betty Chew and others were present ,
ITEM I : CONSIDER FOR APPROVAL MINUTES OF JANUARY 21, 1988 MEETING.
Commissioner Hassler moved approval of the minutes of
the January 21 , 1988 meeting as written . Commissioner
Trogdon seconded the motion. The motion carried by the
following vote :
AYES : All members present voted ave.
NOES : None.
ITEM II : PUBLIC HEARING TO CONSIDER REQUEST TO REZONE FROM B-1
"NEIGHBORHOOD BUSINESS DISTRICT" TO B-2 "SECONDARY AND
HIGHWAY BUSINESS DISTRICT" , 0 . 371 ACRE OF BLOCK 141 ,
CITY ADDITION, KNOWN AS 2330 W. WASHINGTON STREET.
Chairman Castleberry opened the floor for a public
hearing to consider request to rezone from B-1
"Neighborhood Business District" to B-2 "Secondary
and Highway Business District" , 0 . 371 acres of Block
141 , City Addition, known as 2330 W. Washington Street .
Betty Chew, Planning & Inspections Coordinator addressed
the Commission noting the Educational Employees Credit
Union, represented by Mr. Lee Tannahill , is the
owner of the property . They are requesting a change
of zoning from B-1 "Neighborhood Business District"
to B-2 "Secondary and Highway Business District" . The
Comprehensive Plans projected land use is commercial .
The property is served by a 12 inch water main located
at Dale and the South Loop and a 6 inch sewer main
located in Washington. There is an existing water and
sewer tap serving the Property. The property is

served by Washington Street an 80 foot right-of-way
and the South Loop a 120 foot right-of-way. A fire
hydrant is located on the northwest corner of Dale
and the South Loop . The property for which B-2 zoning
is requested is bound to the north by B-2 zoning,
to the east by B-1 zoning and to the south by R-1
zoning.
THOSE IN FAVOR OF ZONING CHANGE :
• Educational Employees
Lee Tannahill,, representing the
Credit Union, addressed the Commission stating they
were proposing to use the property for a restaurant
which is permitted in a B-1 zoning district but are
requesting B-2 zoning to permit a drive-up window
for the restaurant .
Harlan Huey, 2223 South Loop addressed the Commission
questioning if a service station could be placed on
the property if it is rezoned to a B-2 classification.
The Commission responded with a yes , as a service
station is a permitted use in a B-2 zoning district .
There being no one else present wishing to address
the Commission concerning this agenda item, Chairman
Castleberry closed the public hearing.
Commissioner Hassler moved the Planning & Zoning
Commission recommend to the City Council that the
request to rezone from B-1 "Neighborhood Business
District" to B-2 "Secondary and Highway Business
District" , 0. 371 acres of Block 141 , City Addition,
known as 2330 W. Washington Street be approved.
Commissioner Trogdon seconded the motion. The motion
carried by the following vote :
AYES : Commissioners Hassler, Jones , Martin, Singleton,
Terrell and Trogdon .
NOES : None.
ABSTAINED: Chairman Castleberry.
ITEM III : CONSIDER FINAL PLAT OF A REPLAT OF LOTS 7 AND 8, BLOCK 140
AND 145 , CITY ADDITION, ERATH COUNTY , TEXAS .
Danny Johnson,Director of Public Ti7orks addressed the
Commission noting Pat Patterson and Ross Musso , owners
of the property are proposing to replat Lots 7 and 8 ,
Block 140 and 145, City Addition. The proposed Lot 30
will be L shaped having approximately 54, 980 square
feet . The proposed Lot 31 will have 23, 400 square
feet . There are 2 structures being constructed on the
rear portion of Lot 30 . There is an existing building
located at the front of Lot 30 . This structure will
be removed in the near future . Both lots are served
by 6 inch water and sewer mains located in Washington
Street . There are existing taps serving Lot 30 . When
development occurs on Lot 31 a water and sewer tap

will need to be installed. The proposed lots have
frontage on Washington Street . A 25 foot combination
egress and ingress/utility easement is provided on each
lot. There is also a 10 foot water line easement on
Lot 31 . A drainage plan has been submitted and approved
for Lot 30 . A drainage plan will need to be submitted
when development occurs on Lot 31.
Pat Patterson, owner of the property addressed the
Commission stating he was developing the property
with a U shaped shopping center. Mr . Patterson and
Mr. Musso will retain ownership of Lot 30 and will
sell Lot 31 to Mr . Musso ' s brother .
Commissioner Singleton moved the Planning & Zoning
Commission recommend to the City Council that the
Final Plat of a Replat of Lots 7 and 8 , Block 140 and
145 , City Addition, Erath County, Texas be approved
as presented. Commissioner Trogdon seconded the
motion. The motion carried by the following vote :
AYES : Commissioners Hassler , Jones , Martin, Singleton
Terrell and Trogdon .
NOES : None.
ABSTAINED : Chairman Castleberry .
ITEM IV: CONSIDER FINAL PLAT OF A REPLAT OF LOT 2 , BLOCK A,
LIVE OAK ADDITION, ERATH COUNTY, TEXAS .
Betty Chew, Planning & Inspections Coordinator addressed
the Commission noting Mr. Humberson had presented a
preliminary plat to the Commission in January and it
was approved as presented. He is now presenting a
final plat for consideration. Improvement plans will
not be required as utilities are currently provided
on the property.
Charles Humberson, owner of the property addressed
the Commission noting he was requesting annexation
of the . 566 acre area being the eastern portion of
the lot . Mr. Humberson is proposing to build his
residence on the property and wants the entire
structure within the city limits .
Commissioner Martin moved the Planning & Zoning Commission
recommend to the City Council that the Final Plat of
a Replat of Lot 2 , Block A, Live Oak Addition, Erath
County, Texas be approved as presented. Commissioner
Jones seconded the motion. The motion carried by the
following vote :
AYES : Commissioners Hassler, Jones , Martin, Singleton,
Terrell and Trogdon.
NOES : None.
ABSTAINED : Chairman Castleberry .
The Commission discussed the response received on the

Citizen Survey for the Comprehensive Plan Update .
Planning & Inspections Coordinator Betty Chew noted
785 surveys had been completed and returned which
represents a 19% response.
There being no other business to come before the
Commission, the meeting adjourned at 6 : 40 P .M.

Pat Patterson and Ross Musso , owners of the above referenced
property are proposing to replat the above referenced lots .
The proposed Lot 30 will be an L shaped lot having approximately
54, 980 square feet . The proposed Lot 31 will be 23 , 400 square
feet . The property has a B-2 "Secondary and Highway Business
District" zoning classification. There are two structures
presently being constructed on the rear portion of the proposed
Lot 30 . There is an existing building located at the front of

WATER:
Lot 30 and 31 are served by a 6 inch water main located in West
Washington Street . There are two existing water taps located
on the northeast corner of Lot 31 which serve the two buildings
being constructed on Lot 30 . When development occurs on Lot 31
a water tap will need to be installed,
SEWER:
Lots 30 and 31 are served by a 6 inch sewer main located in West
Washington Street . There is an existing sewer tap serving Lot 30 .
When development occurs on Lot 31 a sewer tap will need to be
installed,
STREETS :
The proposed lots have frontage on West Washington Street an 30 foot
right-of-way in this area,
EASEMENTS :
There are 25 foot combination egress and ingress easements/ utility
easements provided between the proposed lots . There is also a
10 foot water line easement provided on Lot 31 ,
DRAINAGE :
A drainage plan has been submitted and approved for Lot 30 , A
drainage plan conforming to the City' s Drainage and Storm Control
Ordinance will need to be submitted when development occurs on
Lot 31 .
The Planning 8, Inspections Staff has reviewed the Final Plat of a
Replat of Lots 7 and 8 , Block 140 and 145 , City Addition and determined
that it complies with the City of Stephenville Subdivision Ordinance .

Charles Humberson, owner of the above referenced property presented
a Preliminary Plat of a Replat of Lot 2 , Block A, Live Oak Addition
to the Planning & Zoning Commission January 21 , 1988 and to the
City Council February 1 , 1988 . The Commission and Council approved
the preliminary nlat as presented.
Mr. Humberson is now presenting the Final Plat for Commission and
Council approval.
Improvement plans for the area will not be required as utilities
are currently provided to the property.
The Planning & Inspections Staff has reviewed the Final Plat of
