The regular meeting of the Planning & Zoning Commission of the City of Stephenville , Texas was called to order by Chairman Charles Castleberry with the following members present : Chairman: Charles Castleberry Members : Don Beach Virginia Dorris Billy_ Hassler Nicki Beth Jones Jerry Singleton Sammy Taylor David Tomlinson Bill Trogdon and with the following member absent : Barbara Terrell. Others attending were Director of Public Works Danny Johnson, Planning & Inspections Coordinator Betty Chew and others . ITEM I : ELECTION OF OFFICERS FOR 1989 . Chairman Castleberry opened the floor to nominations for Planning & Zoning Commission Chairman. Commissioner Trogdon nominated Charles Castleberry to serve as Planning & Zoning Commission Chairman. Commissioner Beach seconded the motion. The motion carried by the following vote : AYES : All members present voted aye. NOES : None. Chairman Castleberry opened the floor to nominations for Planning & Zoning Commission Vice Chairman. Commissioner Singleton nominated Bill Trogdon to serve as Planning & Zoning Commission Vice Chairman. Commissioner Beach seconded the motion. The motion carried by the following vote : AYES : All members present voted aye. NOES : None . ITEM II : CONSIDER FOR APPROVAL MINUTES OF DECEMBER 15 , 1988 AND DECEMBER 19 , 1988 MEETINGS . Commissioner Taylor moved approval of the minutes of the December 15 , 1988 and December 19 , 1988 meetings as written. Commissioner Hassler seconded the motion. The motion carried by the following vote : AYES : All members present voted ave. NOES : None. 1 . ITEM III : PUBLIC HEARING TO CONTINUE CONSIDERATION OF THE REQUEST TO REZONE FROM B-2 "SECONDARY AND HIGHWAY BUSINESS DISTRICT" TO B-4 "PRIVATE CLUB DISTRICT , 8. 95 ACRES OF LOT 2 , BLOCK 74, CITY ADDITION, LOCATED NORTHWEST OF THE INTERSECTION OF SOUTH GRAHAM STREET AND U. S . HWY. 377-67 (SOUTH LOOP) . Chairman Castleberry opened the floor for a public hearing to continue consideration of the request to rezone from B-2 "Secondary and Highway Business District" to B-4 "Private Club District" , 8. 95 acres of Lot 2 , Block 74, City Addition, located northwest of the intersection of South Graham Street and U. S . Hwy. 377-67 (South Loop) , as requested by Thomas Christopher Weir. Betty Chew Planning & Inspections Coordinator addressed the Commission stating Thomas Christopher Weir is requesting a change of zoning from B-2 to B-4. The Comprehensive Plans Projected land use is commercial/public semi-public. There are no structures located on the property at this time. It was noted that water , sewer and fire protection improvements have been shown and approved on the site development plan approved by the Planning & Zoning Commission and City Council . The property has frontage on South Graham Street a 120 ' right-of- way in the area and the South Loop a 150 ' right-of- way. The property for which B-4 zoning is requested is bound on all sides by B-2 "Secondary and Highway Business District" zoning. THOSE IN FAVOR OF ZONING CHANGE : John Rocka, representing the applicant addressed the Commission stating the development would not have direct access to the City Park. Mr. Rocka further stated concern had been expressed regarding safety due to the proposed location. He noted the other private clubs are located adjacent to major thoroughfares . The restaurant will be a family type restaurant and that the economics of the project show the need for the private club in the project . Bill Oxford addressed the Commission stating, as owner of The Oxford House, he was in favor of the rezoning request and the development as it would bring people to Stephenville and be a plus to the hotel industry in the area. Carroll Golightly, 861 S . Graham Street, addressed the Commission stating development of the property will help the area and he and the other property owners in the area would like the sewer being available to them if this project is approved. 2 . THOSE OPPOSED TO ZONING CHANGE : Morgan Garrett addressed the Commission expressing concern for safety in the area with alcohol and increased traffic adjacent to the City Park. Charlene Sloter addressed the Commission stating she would like to see the project come to Stephenville but without the alcohol. Mrs . Sloter further stated the City needs growth but without the alcohol . Buddy Wells addressed the Commission expressing concern regarding safety due to the location. Mr. Wells stated the private club feature is satisfied with existing clubs in the City. Gene Glieser addressed the Commission stating he had lived in other cities and had seen applicants request zoning of this type to increase the value of their property and over a period of time had seen their property and adjoining property devalue not increase in value . There being no one else present wishing to address the Commission, Chairman Castleberry closed the public hearing. Commissioner Dorris expressed concern due to the fact the applicant has never personally addressed the Commission and that due to his age he may be too young to obtain a liquor license. Commissioner Singleton stated he had two problems regarding the rezoning request . The first being the amount of acreage he was requesting be zoned B-4 "Private Club District" (8. 95 acres) and the second problem being the zoning change is to the property and Mr. Weir does not own the property, he is only under contract to purchase the property. Commissioner Singleton moved the Planning & Zoning Commission recommend to the City Council that the request to rezone from B-2 "Secondary and Highway Business District" to B-4 "Private Club District" , 8. 95 acres of Lot 2 , Block 74, City Addition be denied. Commissioner Beach seconded the motion. The motion carried by the following vote : AYES : Commissioners Beach, Dorris, Hassler, Jones, Singleton, Taylor, Tomlinson and Trogdon. NOES : None. ABSTAINED: Chairman Castleberry. Chairman Castleberry requested the Commissioners review the draft copy of the proposed Subdivision Ordinance and a work session would be scheduled in two or three weeks. 3. w d There being no other business to come before the Commission, the meeting adjourned at 7 : 00 P .M. Northwest of Intersection S .Graham - South Loop Location of—Property in Question Thomas Christopher Weir , owner of the above referenced property is requesting a change of zoning from B-2 "Secondary and Highway Business District" to B-4 "Private Club District" . Mr. Weir will be presenting a Site Development Plan for the 47 . 73 acre tract to the Planning & Zoning Commission and City Council in December . COMPREHENSIVE PLAN PROJECTED LAND USE : Commercial/Public-Semi Public BUILDING USE REGULATIONS : City of Stephenville Zoning Ordinance Section XI-II-A. There are no structures located on the property at this time. CITY FACILITIES : Water : The property may be served by a 16" water main which crosses the property. The developer will be required to extend a water main from the 16" water distribution line to the eastern side of the property near S . Graham St . and South Loop . Sewer : The property is not currently served by a sanitary sewer main. The property may be served by extension of a sanitary sewer main from the area of the Bosque River near the bridge on the South Loop . Streets : The property has frontage on S . Graham Street a 120 ' right-of- way in the area and the South Loop a 150 ' right-of-way. Fire Protection: Fire hydrants will need to be installed by the developer on the water main that will be extended from the 16" water main. The fire hydrants will be installed to meet State Board of Insurance guidelines . 1. PZ-89-01-03 EXISTING ZONING IN THE AREA: The property for which B-4 zoning is requested is bound on all sides by B-2 "Secondary and Highway Business District" zoning. 2. . . . 13Z-88-11-06 PZ-89-01-03 NOV I 7. 83 JANI 19 , 892 Applicant seeks to develop the subject property to best and highest usage and potential by fully developing the entire area for commercial and recreational use , including retail business, convenience store , restaurant and club, horse barn, arena, golf driving range, or other purposes . Such development would- utilize this property to the highest and best potential , bringing both commerce and tax dollars to Stephenville , Texas, and providing recreational and tourist attraction as well as a complete utilization of an area that previously has not been considered a desirable location for development. Applicant is preparing a complete site development plan and has had surveys and plats prepared by a licensed surveyor which are attached as a part of this request and made avail- able for examination . Applicant has likewise employed a local architect firm to develop a site plan and parking scheme and maximum devel- opment. Applicant would further show that this zoning change should be made as initial development and grooming of the area is underway at this time in preparation of carrying out the development plan when proper zoning has been achieved. Photographs of the work in progress are attached to show the general area and the feasibility of the development being sought. Applicant is prepared to meet with or make available any additional information that might be required. January 30 , 1989 FILE COPY To Mayor and City Council Members : The Planning & Zoning Commission respectfully submits its annual report to the City Council . The Planning and Zoning Commission met in regular session twelve times and convened in special sessions four times during 1988 . The Commission considered the following during these sessions : Zoning Change Requests 14 Subdivision Requests : Within City Limits (6 . 288 acres) Extraterritorial Jurisdiction (60 acres) 2 Replat/Resubdivision Requests : 10 Site Development Plan Requests : 3 Vacation of Plats : 1 Street & Alley Closing Requests : 1 Amendments to Zoning Ordinance : 6 The Planning & Zoning Commission met twice in work sessions, totaling eight hours , with the Planning & Development Committee of the City Council (Chairperson Helen Martin and Members Vicki Truss and Allen Horne) to complete the first years efforts of the Comprehensive Plan Update . The Commission submitted "Volume I Base Studies" of the City of Stephenville Comprehensive Plan to the City Council December 6 , 1988 . The Councils ' approval of this first years document set in motion the Planning & Zoning Commissions ' comprehensive planning effort for 1989 which includes development of the future land use plan; update of the thoroughfare plan; future water, sewer and solid waste plans ; development of a new subdivision ordinance ; review of the current Zoning Ordinance ; development of a capital improvements plan and annexation plan. The Planning & Zoning Commission programs for 1989 in addition to consideration of requests for zoning changes , subdivision plat and resubdivision requests , will include the following special projects : 1. Comprehensive Plan Update-2010 (Second Years Efforts) 2 . City wide review of unimproved street and alley dedications for closing and sale. 3.
